Concerned alumni in XU-CLI land row await DENR resolution

CONCERNED alumni of Xavier University are now awaiting the resolution of the Department of Environment and Natural Resources (DENR) in the matter concerning the award of patent by the government to the educational institution in 1958.

The controversy stemmed after Xavier University entered a joint venture with developer Cebu Landmasters, Inc. to construct a mixed use township in a portion of the 64-hectare property in upper Balulang, Cagayan de Oro City called Manresa.

The concerned alumni – through a supplemental position paper filed by Atty. Ralph Metillo – said that Section 70 of the Public Land Act prohibited the use of the land for commercial speculation.

The mixed use proposal of Cebu Landmasters, Inc. covers constructing various college facilities for Xavier University but also includes the rise of commercial and residential spaces in the same vicinity.

According to the position paper submitted by the concerned alumni, the patent awarded by the government to Xavier University in 1958 is covered under the Public Land Act.

The position paper is supplemental to the investigation conducted by the DENR regional office in Northern Mindanao which was largely sparked due to the issues raised by the alumni.

The closed door preliminary conference was conducted earlier today (Tuesday, May 5).

Emerging from the hearing, Metillo said they are now looking forward for DENR 10 to recommend a reversion of the 1958 grant.

The recommendation would be forwarded to DENR’s central office which will then initiate the filing for a case of reversion through the Office of the Solicitor General (OSG).

In the meantime, Metillo is urging his clients and the public to be vigilant.

At the same time, he lauded DENR for a “very swift and partial” action on the matter.
